Asheville Tool Library Membership Agreement & Tool Use Policy
Member Conditions:
1. To become a Member (“Member”) of the Asheville Tool Library, Inc. (“the Library”), Members must:
(a) be at least 18 years of age,
(b) create an account at ashevilletoollibrary.myturn.com,
(c) sign the Liability Waiver,
(d) sign this Membership Agreement & Tool Use Policy,
(e) provide one form of photo identification to verify their identity,
(f) pay the annual membership fee ($50-$250) or apply for and receive a Scholarship,
(j) Keep a credit or debit card on file via the Tool Library's secure payment software.
Only the Member or Secondary Member who has signed the Liability Waiver is authorized to check out the Library’s tools.
Member Communication:
2. MyTurn will require members to keep a verified email address and a working credit card on file.
3. It is the responsibility of the member to ensure that we have their correct email address. All emails from the Tool Library will come from an email ending in @ashevilletoollibrary.org. Please make sure that this is in your contacts so you will receive emails from this address.
Member Responsibilities:
4. By checking out a tool, the member assumes the responsibility of knowing when their tools are due, returning them on time, and communicating if there is an issue returning them prior to the due date.
5. By taking possession of any item, the Member is certifying that they are capable of using that item in a safe and proper manner and will only use the item for its intended use.
6. The member is responsible for any person that they allow to use a tool borrowed from the Library.
7. If any borrowed tool becomes unsafe or in a state of disrepair, the Member must immediately discontinue the use of the tool and notify the Library of the issue.
8. Members agree to treat all tool library employees, volunteers, and members with respect. Yelling, cursing, behavior deemed inappropriate, or with the purpose of making another person uncomfortable, may be grounds for having a membership revoked.
9. Treating other members with respect includes returning tools on time and in good condition, so they can be made available to the rest of the community.
Tool Condition:
10. The Library makes reasonable attempts to keep tools in good, working condition. Members are not responsible for damage due to general wear and tear.
11. The Member agrees to return all tools in good, working condition and free of excessive dirt, sawdust, grass, or other debris, as subject to the judgment of the librarian on duty.
12. The Member agrees that the Library is not responsible for any manufacturing defects, in quality of workmanship, or of the materials, in any borrowed tools.
13. The Library does not guarantee the condition of the tools or their sharpness. We kindly request that if you put a lot of wear on a consumable part of the tool, you consider replacing it or making a donation so we can keep the tools usable for the community.
14. The Library will provide fuel for gas-powered equipment, and requests that members use the fuel that we provide, to ensure clean and correct fuel is used.
Overdue, Damaged, Lost, or Stolen Tools:
15. Late fees are $1-3/day, and include days we are closed. Some tools that have a high value or frequent use will have a higher late fee. If a tool is returned late, the Member will be responsible for late fees, which are capped at the full replacement cost of the tool.
16. The Member agrees to pay for the loss of or damage to any item while in their possession, and to accept the Library’s assessment of the condition of the tool. This amount may be up to the full replacement cost of the item plus a $10 administrative fee per tool.
17. The Library agrees to make reasonable efforts to assist members if they are struggling to return tools due to illness, transportation issues, or other extenuating circumstances. If you are concerned about bringing tools back because of late fees or replacement costs, please reach out so we can work with you.
18. Members have 30 days before the Library will begin to charge late fees, according to its late fee policy. Members will be notified before any charges are made and given the opportunity to return tools or make other arrangements. A copy of this policy will be made available to any member that requests it.
19. The member authorizes the Tool Library to charge late fees or the replacement cost of the tool, as described above, to the card on file by checking out a tool.
20. All fees and fines must be paid before members may borrow additional items.
Additional Articles:
21. The Library reserves the right to save credit card and debit card data on our secure payment processing software. Credit and debit card data are not accessible whatsoever to the Library and are tokenized by the software.
22. If a Photo ID or credit card is not available, then other arrangements approved by the board of directors will be considered.
23. The Library may contact members via email and newsletter to relay news and policy updates.
24. The Library may limit the number or value of tools to be taken out at one time by an individual member.
25. I affirm that the information that I have provided on the Membership Application is current, true, and correct. I understand that this information may be subject to verification.
26. I affirm that I understand that failure to comply with any of the above mentioned terms may result in revocation of my membership and/or an inability to renew my membership.
27. I further state that I have read and signed a Waiver and Indemnification form, relinquishing any and all claims against The Asheville Tool Library and any associated business.
By checking here, you are consenting to the use of your electronic signature in lieu of an original signature on paper. After consent, you may, upon written request to us, obtain a paper copy or an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it.
